The hearing regarding Patricia’s probation violation occurred this morning.  The probation officer’s report leading to this hearing is posted. It is only about a page long and part of the motion to revoke her probation.

            It did not take long. The Public Defender took the position that Patricia’s mental illness is of such a severity she can no long assist in her own defense, thus, he contends, she is legally incompetent.

            The judge was not buying it, he noted that he anticipated mental health problems but not the competency issue.

            The Public Defender stated that on two separate occasions he talked with Patricia on the phone and she could neither remember or relate the events surrounding her accused violation. He further noted that a website put up by the defendant’s ex-husband provided evidence of Patricia’s mental illness.

            Glad I could help. Not sure what I posted that could help them prove her legally incompetent, but it nice to know that those three hundred of so hits from State of New Mexico employees are put to good use. Enjoy reading this one guys and girls.

            I am still sticking to my theory that the Beast Machine pushed Patricia over the edge, along with millions of others. I will be the first to testify Patricia was on the edge before the Beast Machine pushed and maybe they did not have to push too hard, put the woman I saw today was not the mother of my children.

            Oh, did I mention Sanders is still involved. He did not show up, but he hired an attorney to represent Patricia and replace the Public Defender after the competency ruling.

            Yes, the judge decided to go ahead with the evaluation, although I agree with his thoughts that Patricia is not legally incompetent, both the DA and the Public Defender were in favor of the evaluation.

            I believe we are all in the same place – the judge, the DA, the public defender, probation, the family, and perhaps Patricia – WE ARE ALL LOST. We do not have a clue what to do next. Perhaps God will smile down and declare her incompetent, some of the parties hope, if not, we will see if we can get a civil commitment, if not, maybe something else will occur to us.

            I understand, I am not sure the path Patricia chose leads back to a point where she can be helped. I am as lost as any of the others, but they do not have to face our children.

            Another interesting fact was that Patricia stood silent. Normally, she is her own worse enemy and rarely will she allow others to control a hearing. Murdoch called her a liar at her sentencing. Judge Sanchez raised her bail to $50,000 cash only after she told him that she was just trying to kill me before I killed her. I thought Judge Walker crazy when I testified at Patricia’s second divorce on coming into the courtroom and finding Patricia in control of the proceeding via a phone line from Grants. When I later listened to the hearing I realized that Judge Walker wisely just got out of Patricia’s way.

            But today she stood mute and let the others talk. A first.

            Sorry, guys but that is the first positive sign I have seen in a while that she is competent.
